1. Agreement to Terms
By accessing or using the services provided by Absolute Ashby Concrete, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services. These terms apply to all visitors, users, and clients who access or use our services.
2. Services Provided
Absolute Ashby Concrete provides professional concrete services including but not limited to driveways, patios, foundations, repairs, and decorative concrete work. All services are subject to availability and may vary based on project requirements, weather conditions, and other factors beyond our control. We reserve the right to refuse service to anyone for any reason at any time.
3. Estimates and Pricing
All estimates provided are based on the information available at the time of inspection. Final pricing may vary if site conditions differ from initial assessments or if the scope of work changes. We provide written estimates before beginning any work. Payment terms will be outlined in your service agreement. Prices are subject to change without notice, but any changes will be communicated to you before work begins.
4. Client Responsibilities
Clients are responsible for ensuring clear access to the work area, obtaining any necessary permits or approvals from homeowners associations or local authorities, and providing accurate information about underground utilities or other site conditions. Clients must also ensure that pets are secured and that children are kept at a safe distance from the work area. Failure to meet these responsibilities may result in delays or additional charges.
5. Warranties and Guarantees
We stand behind the quality of our work. Specific warranty terms will be provided in your service agreement and may vary depending on the type of service performed. Warranties cover defects in workmanship and materials but do not cover damage caused by improper use, neglect, accidents, natural disasters, or normal wear and tear. Any warranty claims must be submitted in writing within the warranty period.
6. Limitation of Liability
To the fullest extent permitted by law, Absolute Ashby Concrete shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services. Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim. This limitation applies regardless of the legal theory upon which the claim is based.
7. Weather and Delays
Concrete work is weather-dependent. We will make every effort to complete your project on schedule, but delays due to rain, extreme temperatures, or other weather conditions are beyond our control. We are not liable for delays caused by weather, site conditions, or other circumstances outside our reasonable control. We will communicate with you about any delays and work to reschedule as quickly as possible.
8. Changes to Services
Any changes to the scope of work must be agreed upon in writing by both parties. Changes may affect the project timeline and cost. We will provide you with a written change order detailing any modifications to the original agreement before proceeding with additional work. You are not obligated to approve changes, and we are not obligated to perform work outside the agreed-upon scope without written authorization.
9. Payment Terms
Payment terms will be outlined in your service agreement. We typically require a deposit before work begins, with the balance due upon completion. Acceptable payment methods include cash, check, and credit card. Late payments may be subject to interest charges or collection fees. If payment is not received as agreed, we reserve the right to file a lien against the property.
10. Cancellation Policy
If you need to cancel your project, please notify us as soon as possible. Cancellations made before work begins may be subject to a cancellation fee to cover administrative costs and lost scheduling opportunities. If work has already started, you will be responsible for payment for all work completed and materials purchased up to the point of cancellation.
11. Dispute Resolution
If a dispute arises between you and Absolute Ashby Concrete, we encourage you to contact us first to resolve the issue informally. If we cannot reach a resolution, any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Massachusetts, and the decision of the arbitrator shall be final and binding.
12. Changes to Terms
We reserve the right to update or modify these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Your continued use of our services after any changes indicates your acceptance of the new terms. We encourage you to review this page periodically to stay informed about our policies.
